Abstract
In the course of the liberalization of European energy markets, the German government opted – diverging from all other European countries – for Negotiated Third-Party Access. In this article we analyze if, theoretically, this institutional regime can be superior to regulation. We review empirically whether certain aspects of the actual implementation, in particular publication of the network access charges for each network supplier, facilitated or inhibited competition. In the first place we reconsider previous research, showing that NTPA can – under certain conditions – be economically effective. Our empirical analysis shows that the duty of publishing access charges supported market transparency and imposed a regulatory threat, particularly to suppliers with significantly above-average charges. On the other hand observable price adjustments over time serve as an indicator of tacit collusion. Although the expensive suppliers cut their prices, the cheaper ones raised theirs.

Abstract
Theoretischen Implikationen zufolge wird der Erfolg von Unternehmen durch die Kooperation und Netzwerkeinbindung begünstigt. Im Biotechnologiesektor ist die Kooperationsneigung der Firmen stark ausgeprägt. Schätzungen des Wachstums der Firmen in Abhängigkeit von kooperations- und nichtkooperationsbezogenen Faktoren zeigen einen signifikant positiven Wachstumseinfluss der Kooperationsneigung und Vernetzung. Dabei spielen Wissenschaftseinrichtungen in räumlicher Nähe der Unternehmen eine wichtige Rolle. Aus der Analyse ist zu verallgemeinern und auch für andere Branchen zu folgern: Netzwerke entstehen unter bestimmten Bedingungen von selbst. Dennoch sollte ihre Bildung und Entwicklung unterstützt werden, etwa durch Stärkung der Leistungsfähigkeit der öffentlichen Forschung und Hochschulausbildung sowie durch intensivere Kooperation und Vernetzung zwischen dem Wissenschafts- und Unternehmenssektor. Dies kann den Technologie- und Humankapitaltransfer begünstigen.

Network Access Charges, Vertical Integration, and Property Rights Structure

Abstract
After the deregulation of the German electricity markets in 1998, the German government opted for a regulatory regime called negotiated third party access, which would be subject to ex post control by the federal cartel office. Network access charges for new competitors are based on contractual arrangements between energy producers and industrial consumers. As the electricity networks are incontestable natural monopolies, the local and regional network operators are able to set (monopolistic) charges at their own discretion, limited only by their concerns over possible interference by the federal cartel office (Bundeskartellamt). In this paper we analyse if there is evidence for varying charging behaviour depending on a supplier`s economic independence (structure of property rights) or its level of vertical integration. For this purpose we hypothesise that incorporated and vertically integrated suppliers set different charges than independent utility companies. Multivariate estimations show a relation between network access charges and the network operator’s economic independence as well as level of vertical integration. On the low voltage level, for an estimated annual consumption of 1700 kW/h, vertically integrated firms set – as predicted by our hypothesis - significantly lower access charges than vertically separated suppliers, whereas incorporated network operators charge significantly higher charges compared to independent suppliers. There is insufficient evidence available to confirm these results for other consumptions or voltage levels.

Abstract
Mit dem Vorhandensein von Unternehmensnetzwerken wird zumeist eine hohe Wettbewerbsfähigkeit der Wirtschaft in der betreffenden Region assoziiert. Eine erstmals flächendeckend für Ostdeutschland vorgenommene Bestandsaufnahme von Unternehmensnetzwerken zeigt eine erhebliche räumliche Ungleichverteilung von Netzwerkaktivitäten zugunsten der sächsischen Agglomerationsräume und zugunsten der Hauptstadtregion. Diese räumlichen Schwerpunkte der Netzwerkbildung lassen erkennen, dass sich Netzwerke am ehesten dort herausbilden und entwickeln, wo sie günstige „natürliche“ Entwicklungsbedingungen, d. h. vor allem eine hohe Dichte von Unternehmen und Wissenschaftseinrichtungen vorfinden. Dort können zugleich besonders intensive lieferund abnehmerseitige Verflechtungen vermutet werden. Dass die höher verdichten Regionen günstige „natürliche“ Bedingungen für die Etablierung von Netzwerken darstellen, wird auch an dem Umstand deutlich, dass in diesen Räumen besonders häufig Übereinstimmungen zwischen Unternehmensnetzwerken und regionalen Branchenschwerpunkten gegeben sind. Diese Übereinstimmungen können als vorteilhaft für die Regionalentwicklung angesehen werden, weil sie Indizien für das Vorhandensein von längerfristig gegebenen tendenziell nachhaltigen Netzwerkstrukturen sind. In dünn besiedelten, ländlich-peripheren Region ist dagegen die Zahl der Unternehmensnetzwerke zumeist gering, und sie werden sehr häufig nicht durch einen regionalen Branchenschwerpunkt begleitet. Es stellt sich die Frage nach der künftigen Bestandsfestigkeit der Unternehmensnetzwerke gerade in diesen Regionen mit geringer Verdichtung. Diese Frage erhält noch zusätzliches Gewicht, weil öffentliche Förderhilfen, die viele Netzwerke in Ostdeutschland erhalten, zeitlich befristet sind und daher die Fortexistenz der Netzwerke auch ohne Förderung eine besondere Herausforderung darstellt.

The Contestable Markets Theory - Efficient Advice for Economic Policy

Abstract
During the nineties of the last century several formerly monopolistic markets (telecommunication, electricity, gas, and railway) have been deregulated in Germany based on European directives and theoretically inspired by the theory of contestable markets. The original contestable market theory implied three assumptions necessary to be satisfied to establish potential competition: Free market entry, market exit possible without any costs, and the price adjustment lag exceeding the entry lag. Our analysis shows that if the incumbent reduces its prices slowly (high adjustment lag) and the market entry can be performed quickly (low entry lag), a new competitor will be able to earn back sunk costs. Therefore it is not necessary that all three conditions be complied with for potential competition to exist. Applying this „revised“ contestable market theory to the deregulated sectors in Germany, natural monopolies can be identified in telecommunication sections local loops and local/regional connection networks, in the national electricity grid and the regional/local electricity distribution networks, in the national and regional/local gas transmission/distribution sections, and in the railroad network. These sections are not contestable due to sunk costs, expected high entry lags and a probably short price adjustment lag. They are identified as bottlenecks, which should be regulated. The function of system operators in energy and railroad are closely related to the non-contestable monopolistic networks.

The influence of Vertical Integration and Property Rights on Network Access Charges in the German Electricity Markets

Abstract
German Electricity markets were deregulated in the late nineties of the last century. In contrast to other European countries, the German government enacted negotiated third party access instead of installing a regulation authority. Network access charges for new competitors are based on contractual arrangements between energy producers and industrial consumers, which specify the calculation schemes for access charges. Local and regional suppliers are nevertheless able to set (monopolistic) charges at their own discretion, restricted only by the possibility of interference competition authorities. While some of those suppliers have been acquired by one of the four Transmission System Operators and become vertically integrated, the majority is still independent public utility companies. In this paper we analyse if there is evidence for different charging behaviour depending on the supplier’s economic independence or its level of vertical integration. Controlling for other coefficients as the so called structural features and related cost differences as well as the influence of competition law suits, multivariate estimations show significantly lower access charges than vertically separated suppliers, whereas incorporated network operators charge significantly higher charges compared to independent suppliers for at least one typical case.

Innovation cooperation: experiences from East and West Germany

Abstract
This paper deals with innovation cooperation as a means to support the ongoing catch-up process of the East German economy. Against prevalent beliefs, it can be shown that East German enterprises are more often involved in innovation co-operation than West German firms, and differences in cooperation partner priorities only reflect the given structural differences between the two regions. While cooperating enterprises in East and West Germany are clearly more innovative than their non-cooperating counterparts, a productivity advantage of these firms is (so far) only observable in West Germany. Reasons for this surprising finding are discussed.

Abstract
Industrial productivity levels of formerly socialist economies in Central East Europe (including East Germany) are considerably lower than in the more mature Western economies. This research aims at assessing the reasons for lower productivities at the firm level: what are the firm-specific determinants of productivity gaps. To assess this, we have conducted an extensive field study and focussed on a selection of two important manufacturing industries, namely machinery manufacturers and furniture manufacturers, and on the construction industry. Using the data generated in field work, we test a set of determinant-candidates which were derived from theory and prior research in that topic. Our analysis uses the simplest version of the matched-pair approach, in which first hypothesis about relevant productivity level-determinants are tested. In a second step, positively tested hypothesis are further assessed in terms of whether they also constitute firm-specific determinants of the apparent gaps between the firms in our Eastern and such in our Western panels. Our results suggest that the quality of human capital plays an important role in all three industrial branches assessed. Amongst manufacturing firms, networking activities and the use of modern technologies for communication are important reasons for the lower levels of labour productivity in the East. The intensity of long-term strategic planning on behalf of the management turned out to be relevant only for machinery manufacturers. Product and process innovations unexpectedly exhibit an ambiguous picture, as did the extent of specialisation on a small number of products in the firms’ portfolio and the intensity of competition.

Der vorliegende Beitrag enthält die Prognose der wirtschaftlichen Entwicklung im Euroraum, die das IWH im Rahmen des European Forecasting Network im Frühjahr erstellt hat. Darin wird ein moderater Anstieg des realen Bruttoinlandsprodukts von 1,2% in diesem auf 2,1% im kommenden Jahr erwartet. Die derzeitige Wachstumsschwäche ist vor allem strukturell bedingt. Zu nennen sind insbesondere die Arbeitsmärkte, die in den meisten Ländern zu wenig flexibel sind.
